Hon. C. S.

Have all statements and depositions in this case attached

with a report from the C. S. P. Was this man entitled to go

into a brothel in pursuit of a hawker? Was he sent on duty

to look after hawkers on that evening? If not, what was his

particular duty at the time ?

Hon. 601. See.

I should say he had a right to go into any house in

pursuit.

2. No. He was on regular Police duty which embraces

supervision of hawkers.

Your Excelleney

I question whether a Police offieer may enter a house

wit

in pursuance of a hawker merely to ascertain whether he has a

license. I should say he had no right to do so. A Police officer frequenting brothels is liable to instant dismissal under the Police regulations. Therefore Inspector MacDonald's answer to the Court should have been that a policeman has no business in a brothel for improper purposes either in or out of uniform. I think the man should be dealt with departmentally (1) for entering a brothel in uniform (2) being off his section (3) gossiping and wasting his time on duty.
